Terms of Service

Plain English summary: Found is a matchmaking tool, not a guarantee of love, safety, or outcomes. You meet people at your own risk. You are solely responsible for your choices — online and in person. We provide software; you provide judgment. By using Found, you accept everything below. Please read it all.

1. Agreement to these Terms

These Terms of Service ("Terms") form a legally binding contract between you and Found Matchmaking ("Found", "we", "us", "our"), based in Sydney, New South Wales, Australia, and govern your use of the Found mobile application, website, and all related services (collectively, the "Service").

By creating an account, downloading, accessing, or using Found in any way, you confirm that you have read, understood, and agreed to these Terms in full, and that you are legally able to enter into this contract. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 18 years old. No exceptions.
You must be legally permitted to enter a binding contract in your country.
You must not be a registered sex offender, on any government sanctions list, or banned from similar services.
You must not have had a previous Found account terminated for violation of these Terms.
You must use your real identity, real name, real photos, and real information.

We may terminate any account we reasonably suspect fails to meet these requirements, at any time, without notice or refund.

3. Your account

You are solely responsible for your account, your password, and all activity that occurs under it. You agree to notify us immediately of any unauthorised use. We are not liable for losses caused by unauthorised access resulting from your failure to keep your credentials secure.

4. Subscriptions, payments, refunds

Found offers free and paid subscriptions. Paid plans are processed through the Apple App Store.
Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period, through your Apple ID settings.
All sales are final. Refund requests are handled by Apple under the App Store refund policy, not by Found. We do not issue direct refunds.
Prices may change. We will notify you of any price change before it takes effect.
If your payment fails, we may suspend premium features until payment is resolved.

5. How Found works (and what it doesn't promise)

Found uses AI-assisted matchmaking, location-based proximity, and human-centred design to help users find meaningful connections. However:

We do not guarantee you will find a match, a date, a relationship, love, happiness, marriage, or any specific outcome.
We do not guarantee that other users are who they say they are, despite our verification efforts.
We do not guarantee that matches will be compatible, kind, safe, truthful, or available.
We do not conduct criminal background checks on users. You should not assume any user is safe.
AI recommendations are experimental, imperfect, and for informational purposes only.

6. User conduct — what you must not do

You agree that you will not:

Impersonate any person or misrepresent your identity, age, or relationship status.
Use the Service to harass, stalk, threaten, defame, defraud, or harm anyone.
Solicit money, gifts, or services from other users.
Engage in sex work, escorting, or any commercial solicitation.
Share illegal, hateful, violent, sexually explicit, or child-endangering content.
Spam, scrape, reverse-engineer, or automate the Service.
Create multiple accounts or use the Service after being banned.
Use the Service if you are married or in a relationship without your partner's knowledge (unless that is openly stated).
Meet another user for any illegal purpose.
Violate any applicable law.

Violations may result in immediate termination without notice, refund, or appeal, and may be reported to law enforcement.

7. Meeting other users — READ THIS CAREFULLY

⚠️ ASSUMPTION OF RISK — IN PERSON MEETINGS

You understand and agree that meeting people in real life carries inherent risks, including risks of physical harm, emotional harm, theft, fraud, sexual assault, disease, stalking, harassment, and death. You accept these risks fully and voluntarily.

Found does not verify criminal records. Found does not supervise meetups. Found is not present, responsible, or liable for anything that happens before, during, or after any interaction with another user — whether online or offline.

You are solely responsible for deciding whether to meet, where to meet, how to meet, whom to trust, and what to do in any situation. Always meet in a public place, tell a trusted friend your plans, and trust your instincts.

If something feels wrong, leave. If you are in danger, call 000 (Australia), 911 (USA), 999 (UK), or your local emergency number immediately.

8. Content you post

You retain ownership of photos, messages, voice notes, and any content you post. However, by posting, you grant Found a worldwide, royalty-free, sublicensable, transferable licence to host, store, display, reproduce, modify, and distribute your content solely for the purpose of operating, promoting, and improving the Service.

You confirm that you own or have the right to share all content you post, and that it does not infringe any third-party rights.

We may remove any content at any time for any reason without notice.

9. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, OR AVAILABILITY.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT ANY MATCH, INTERACTION, OR RESULT WILL MEET YOUR EXPECTATIONS.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL FOUND, ITS FOUNDERS, OFFICERS, EMPLOYEES, AGENTS, PARTNERS, OR AFFILIATES BE LIABLE FOR:

Any indirect, incidental, consequential, special, punitive, or exemplary damages.
Any loss of profits, revenue, data, goodwill, or reputation.
Any physical, emotional, psychological, or financial harm caused by another user or by a meeting arranged through the Service.
Any damages arising from your use of, or inability to use, the Service.
Any damages arising from third-party content, AI errors, or matches.

IF, DESPITE THE ABOVE, FOUND IS FOUND LIABLE FOR ANYTHING, OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS COMBINED WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FOUND IN THE SIX MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) AUD $100.

Some jurisdictions do not allow certain limitations. In those jurisdictions, our liability is limited to the minimum permitted by law.

11. Indemnification

You agree to indemnify, defend, and hold harmless Found, its founders, employees, affiliates, and agents from any claim, loss, damage, liability, cost, or expense (including reasonable legal fees) arising from:

Your use or misuse of the Service.
Your breach of these Terms.
Your interactions with other users, online or in person.
Your content.
Your violation of any law or third-party right.

12. Termination

We may suspend or terminate your access to the Service at any time, for any reason, with or without notice, including if we believe you have violated these Terms. Termination does not entitle you to a refund. Sections that by their nature should survive termination (including Sections 7–13) will survive.

13. Dispute resolution, governing law, and class action waiver

These Terms are governed by the laws of New South Wales, Australia, without regard to conflict-of-law principles.

Any dispute arising from or relating to these Terms or the Service will be resolved first by good-faith negotiation. If unresolved within 30 days, the dispute shall be submitted to binding arbitration administered in Sydney, Australia, under the rules of the Australian Centre for International Commercial Arbitration (ACICA), and the seat of arbitration shall be Sydney.

You agree that any dispute will be resolved on an individual basis only. You waive any right to participate in a class action, collective action, or representative action against Found.

Nothing in this section prevents either party from seeking injunctive relief in court for intellectual property or confidentiality claims.

14. Changes to these Terms

We may update these Terms at any time. Material changes will be announced in-app or by email. Continued use after changes means you accept the revised Terms.

15. Miscellaneous

Entire agreement: These Terms, together with our Privacy Policy, are the entire agreement between you and Found.
Severability: If any provision is found invalid, the rest remains in full effect.
No waiver: Our failure to enforce any provision is not a waiver of that provision.
Assignment: You may not assign these Terms. We may assign them freely.
No agency: Nothing creates a partnership, employment, or agency relationship.
